Petitioner apprehends his arrest in connection with Desari P.S. Case No. 95 of 2016 registered under Sections- 406, 409, 419,420, 467, 468, 471, 120B of the Indian Penal Code. The allegation against the petitioner is that he alongwith other accused persons conspired, manufactured JOB card of MANREGA Scheme and withdrawn amount in the name of the complainant. It is also alleged that they withdrew money in the name of the others also showing them to be MANREGA Job Card holder.
Learned counsel for the petitioner submits that complainant has himself withdraw the amount from the bank as
Patna High Court Cr.Misc. No.2239 of 2017 (2) dt.28-01-2017 2/2 would be evident from vouchers available with the bank. Petitioner is a Banker and has no role in preparing Job Card of labourers to work under MANREGA. Many persons, whose money is said to have been withdrawn by the petitioner, have approached the Bank and given in writing that they have received the payment.
Considering the facts and circumstances of the case, the petitioner, above named, in the event of arrest or surrender within a period of four weeks from today, is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Vaishali at Hajipur in connection with Desari P.S. Case No. 95 of 2016 subject to the conditions as laid down under section 438(2) of the Code of Criminal Procedure.
