JUSTICE VINOD KUMAR SINHA ORAL ORDER 24-07-2019 This application, for grant of anticipatory bail, arises out of Triveniganj P.S. Case No. 391 of 2017, disclosing offences under Sections 420, 467, 468, 471, 406/34 of the Indian Penal Code. Allegation as per F.I.R. is that petitioner got a forged sale deed executed for the land of Thakurbadi.

It appears that on appearance of opposite party no. 2, the matter was referred to the Patna High Court Mediation and Conciliation Center vide order dated 18.06.2019 and now learned Mediator's report is available at Flag - 'M', which disclosed that dispute between the parties have been resolved through the process of Mediation on the terms of settlement mutually agreed upon by the parties. It further appears that during course of mediation, petitioner has stated that he has already handed over the land to the land owner Sri Sri 108, Ram Janki Thakurbari and payment has already been made. The opposite party no. 2 has stated that if the petitioner handed

Having heard both sides, in view of the above facts, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -I, Supaul, in connection with Triveniganj P.S. Case No. 391 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure.

It is further subject to the condition that the parties shall abide by the terms and condition mutually agreed upon between them.
