2. In this case, the petitioner is seeking regular bail in connection with Barhara (Sinha O.P.) P.S. Case No. 493 of 2021, registered for the offences punishable under Section 302/34 of the IPC.
3. As per allegation, two accused persons including the petitioner came to the house of the informant and killed her son namely Guddu Kumar by pressing his neck.
4. The learned counsel for the petitioner has submitted that the petitioner is a person of clean antecedent and has falsely been implicated in this case due to ulterior motive. He has submitted further that the deceased used to quarrel with his wife
Patna High Court CR. MISC. No.46573 of 2023(8) dt.03-07-2024 2/2 and perhaps she killed her husband in sleeping condition. As a matter of fact, wife of the deceased had illicit relation with the petitioner. The petitioner is under custody since 20.12.2022.
5. On the other hand, the learned APP for the State has opposed the prayer for bail and submitted that the petitioner committed murder of the deceased by throttling his neck. He has submitted further that in paragraph nos. 6 and 7 of the case diary, the witnesses have fully supported the occurrence.
6. Considering the above-mentioned facts and circumstances, I am not inclined to grant bail to the petitioner. Accordingly, it is rejected.
