JUSTICE SANJAY PRIYA ORAL ORDER 26-10-2018 Heard learned counsel for the petitioner, learned APP for the State as well as learned counsel for the informant. The petitioner seeks bail in Beur P. S. Case No. 156 of 2018 instituted for the offence under Section(s) 302/120(B)/34 of the Indian Penal Code and Section 27 of the Arms Act.

In the written report, it is alleged that informant received information that his brother has sustained injury. Thereafter, the informant went to the place of occurrence with his nephew and found his brother was lying in serious injured condition and this

It is further alleged that informant reached near his brother and his brother disclosed to him that co accused Sanjay and Guddu made firing on him due to money dispute.

The police has during investigation implicated this petitioner and has submitted charge sheet on the basis of supervision note.

Petitioner is in custody since 29.6.2018.

Learned counsel for the informant has submitted that there are several injuries on the person of the deceased as would appear from the postmortem report.

Case diary has been received. Learned counsel for the State after looking into the case diary has submitted that there is no eye witness of the occurrence. There is no any specific allegation attributed to the petitioner of causing overt act to the deceased.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM-cum Sub Judge 8th Patna, in connection with Beur P. S. Case No. 156 of 2018 subject to

Patna High Court Cr.Misc. No.59125 of 2018(3) dt.26-10-2018 3/3 the condition that both the bailers shall be the close relative of the petitioner.
