This is an application for bail in connection with Sadar (Saharsa) P.S. Case No. 898 of 2016, registered for the offences punishable under Sections 419, 420, 467, 468, 120B, 504, 406, 471 and 384/34 of the Indian Penal Code.

Allegation against the petitioner is of assisting the main accused in manufacturing the forged agreement against the informant and his son.

Submission of learned counsel for the petitioner is that at best he is only witness to the agreement and except that there is nothing against him and he has falsely been implicated because of suspicion that he has taken side of claimant owner Sudha Singh and petitioner is in custody since 26.8.2017. Heard learned APP and learned counsel for the informant. Learned counsel for the informant has opposed prayer for bail on the ground that agreement was sent to FSL and from the report of FSL it appears that signature of informant is forged in

Patna High Court Cr.Misc. No.50283 of 2017 (3) dt.10-11-2017 2/2 the agreement. However, he could not controvert the fact that petitioner is only witness to the agreement.

Having heard both sides and in view of facts and circumstances, as stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Saharsa, in connection with Sadar (Saharsa) P.S.Case No. 898 of 2016, subject to the conditions as follows :

(1) One of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of the court concerned, (2) Petitioner will co-operate in trial and appear on each and every date in court and on failure to appear on two consecutive dates without any genuine ground or without permission of court, his bail bond shall be cancelled.
