The petitioners apprehend their arrest in a case registered for the offences punishable under Section 302/34 of the Indian Penal Code.

As per the prosecution case, both petitioners along with other co-accused person committed murder of the son of informant and hanged the dead body on a tree. It is submitted that petitioner no. 1 is wife of the deceased and petitioner no. 2 is the sister of petitioner no. 1. It is next submitted that informant is not eye-witness of the occurrence and in fact the deceased committed suicide. As per

Patna High Court CR. MISC. No.43333 of 2022(3) dt.13-03-2023 2/2 the postmortem report, the cause of death is asphyxia due to hanging and no external injury has been found on the person of deceased. Many witnesses in their statement have stated that the deceased committed suicide. Petitioners are ladies and claim clean antecedent.

Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Forbesganj (Simraha) P.S. Case No. 43 of 2022, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
