The petitioner seeks bail in Rahika P.S. Case No.63 of 2017 registered under Section 419, 420, 379 and 411 of the Indian Penal Code.
As per the prosecution case, informant and seven other ladies are said to have given their ornaments to the petitioner on the promise that the same would be returned on the following day with the steel box and on suspicion she was apprehended by them and produced before the police.
It is submitted by learned counsel for the petitioner that no such occurrence as alleged ever took place. As a matter of fact, the petitioner happens to be a hawker of plastic made articles and she used to sell the same in the locality. During course of sale, an altercation with the informant and other ladies regarding
Patna High Court Cr.Misc. No.54031 of 2017 (02) dt.14-11-2017 - 2 - price of the article took place and due to this she has been falsely implicated in this case. It is quite improbable that a person will hand over his ornaments for returning the same with steel box. The petitioner has been languishing in custody since 25.05.2017. Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate 1st, Madhubani in connection with Rahika P.S. Case No.63 of 2017.
