The petitioner seeks bail in anticipation of his arrest in connection with Muffasil (Lakho) P. S. Case No.131 of 2020, instituted for the offences under Sections 120(B) of the Indian Penal Code and Section 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018. The learned counsel for the petitioner, at the outset, submits that petitioner is a person of clean antecedent. From bare perusal of the allegation as alleged in the F.I.R., it would manifest that on secret information that one Vikram Kumar is selling foreign liquor and on such

Patna High Court CR. MISC. No.40948 of 2020(2) dt.26-10-2021 2/3 information, informant along with other police party proceeded to said place and search was made from where 29.55 litres of liquor was recovered from the house near bank of Gandak river and accordingly, seizure list was prepared.

The learned counsel for the petitioner submits that from bare perusal of the seizure list at Page-14, it would manifest that the seizure of the liquor was made from the ditch North to the house of Gauri Shankar Thakur of village-Shahpur. The learned counsel for the petitioner submits that neither the recovery made from the place belongs to the petitioner nor petitioner was apprehended at the spot despite secret information and the petitioner is a person of clean antecedent.

Regard being had to the facts afore-stated, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of eight weeks, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2nd-
