JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-01-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 27.7.2017 passed in Cr.Misc.No. 28450 of 2017 on merit.
Submission of learned counsel for the petitioner is that petitioner has remained in custody for ten months and there is no progress in trial.
Heard learned APP also.
A report dated 20.12.2017 has been received from the court of Additional Chief Judicial Magistrate, Danapur, from which it appears that the case shall be committed to the court of Sessions on 2.1.2018 if the accused are present in court. In the facts and circumstances, I am not inclined to grant bail to the petitioner.

No.60579 of 2017 (3) dt.03-01-2018 2/2 However, learned court below is directed to see that the case is committed to the court of sessions and all the accused have to co-operate and be present in court on the date fixed. Learned trial court is directed to expedite the trial after commitment.
