JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 05-09-2023 Heard Mr. Akshansh Ankit, learned counsel appearing on behalf of the petitioner; Mr. Balram Kapri, learned AC to learned SC-26 appearing on behalf of the State and Mr. Ram Yash Singh, learned counsel for the Accountant General, Bihar.

2. Learned counsel appearing on behalf of the petitioner submits that petitioner is entitled for 90 percent pension in accordance with Sub-Rule (c) of Rule 43. However, in spite of several representation filed by the petitioner before the Principal Secretary, Cooperative Department, Government

Patna High Court CWJC No.9964 of 2023 dt.05-09-2023 2/2 of Bihar, Patna- respondent no. 2, the petitioner has been forced to file the present writ petition.

3. Considering the limited relief(s) sought for by the petitioner in the present writ petition, the Principal Secretary, Cooperative Department, Government of Bihar, Patnarespondent no. 2, is directed to call for the service records relating to the petitioner and sanction 90 percent pension in accordance with law. The same is directed to be communicated to the Accountant General, Bihar for issuing authority in favour of the petitioner and the same be communicated to the Treasury Officer, Patna.

4. All the above exercise is directed to be concluded within a period of four weeks from the date of communication of this order.

5. With above observation and direction, the present writ petition is disposed of.
