The petitioner apprehends his arrest in connection with Majhaulia P.S. Case No. 15 of 2016 registered under Sections 457 and 380 of the Indian Penal Code.
Learned counsel for the petitioner submits that petitioner is not named in the F.I.R. rather on the basis of written report of Branch Manger, State Bank of India, Paras Pakri, Bettiah, present case has been lodged against unknown. In course of investigation, one Snjay Yadav was arrested by the police, who
Patna High Court Cr.Misc. No.44286 of 2016 (2) dt.22-10-2016 confessed about committing theft in the Bank by using Balero vehicle bearing registration no. BR-05H-5830 belonging to the petitioner, in fact, said Balero vehicle is belonging to Upendra Yadav, neighbour of the petitioner and that Balero vehicle has already been released in favour of Upendra Yadav. It is further submitted that, in fact, co-accused, Sanjay Yadav, is son of cousin maternal uncle of the petitioner and due to dispute as petitioner used to reside at the house of maternal uncle, he disclosed the name of the petitioner.
Having regard to the facts and circumstances of the case, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Bettiah, in connection with Majhaulia P.S.
