JUSTICE SATYAVRAT VERMA ORAL ORDER 15-02-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. Let the defect(s), if any, be removed within a period of four weeks after complete start of the physical Court. The petitioner seeks regular bail in connection with Samastipur (Town) P.S. Case No. 56 of 2021 instituted for the offences under Sections 341, 323, 324, 326, 307, 504 and 506/34 of the Indian Penal Code as well as Section 27 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner is in custody since 05.04.2021, is a person with clean antecedent and charge-sheet has been submitted. The informant in the FIR alleges that this petitioner fired at him causing injury in his abdomen.

No.53588 of 2021(2) dt.15-02-2022 2/2 Learned counsel for the petitioner submits that from perusal of the allegation as alleged it would manifest that both the petitioner and the informant were standing on the road and were talking with their group and the petitioner felt that the informant and his group were abusing him as a result of which the present occurrence took place.

Learned A.P.P. for the State vehemently opposes the prayer for regular bail of the petitioner.

Considering the fact that there is direct allegation of firing against this petitioner causing injury in the abdomen of the informant as has been recorded in the impugned order also, the Court for the present is not inclined to grant bail to the petitioner in connection with the aforesaid case pending in the Court of learned Chief Judicial Magistrate, Samastipur.
