JUSTICE MOHIT KUMAR SHAH ORAL ORDER 03-08-2018 The present writ petition has been filed seeking a direction to the respondents to take re-measurement of height of the petitioner.

The present case arises out of an advertisement of the year 2009 and much water has flown during the interregnum period. Nonetheless, the respondents have filed a counter affidavit in which they have submitted that the height of the petitioner was found to be 163.5 c.m. during the course of Physical Evaluation Test and later on the petitioner had filed an appeal, thereafter his height was found to be 163.4 c.m., however, minimum prescribed height for selection of the candidate is 165 c.m. (under the

Patna High Court CWJC No.19843 of 2010 (4) dt.03-08-2018 2/2 category of Backward Class Male Home guard).

In view of the aforesaid, since the petitioner has failed to qualify on account of him not having the standard height required for appointment to the police force, the present writ petition is devoid of any merit, hence the same is dismissed. (Mohit Kumar Shah, J) BTiwary/Md. Rashid U
