In view of the materials brought on record, the Court is satisfied that the petitioner's brother having retired from the post of Night Guard is entitled to only a maximum encashment of 120 days of unutilized earned leave has been paid the same. However, with regard to payment of EPF, it is submitted that the up-to-date pass book has to be produced before the Principal of the college for making calculation so that the money could be withdrawn. It is further submitted that the Principal (respondent no. 5) is on leave and shall be joining only on 24th November, 2015.
In view of the aforesaid, the writ petition stands disposed off with a direction to the respondent no. 5 to ensure that the formalities with regard to payment of EPF is complete and
Patna High Court CWJC No.5642 of 2007 dt.27-10-2015 2/2 payment made to the petitioner latest by 10th November, 2015, failing which the petitioner may bring such fact to the notice of the Court. To facilitate the matter, let the petitioner appear before the respondent no. 5 on 2nd November, 2015 along with a copy of this order and all the required papers and also complete the formalities.
