The petitioner is in custody since 23.06.2017 in connection with Biroul P.S. Case No. 277 of 2017 for the offence registered under Sections 461, 379 and 411 of the Indian Penal Code.
Learned counsel for the petitioner submits that though the petitioner is said to have been identified yet the recoveries are not made from his possession and the entire story is concocted and far-fetched. Admittedly, the informant had not identified the petitioner at the first instance when the C.C. TV. footage was observed by him. Subsequently, on the basis of mischievous report, the petitioner has been named in the first information report.

No.52023 of 2017 (2) dt.09-11-2017 2/2 Considering the aforesaid facts and circumstances of the case and that the petitioner has no criminal antecedent, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Biroul, Darbhanga in connection with Biroul P.S. Case No. 277 of 2017.
