JUSTICE DINESH KUMAR SINGH ORAL ORDER 17-12-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 147, 148, 323, 379, 504 and 506 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.
It is alleged that the accused persons came variously armed abused the informant by calling caste name and dragged the informant to his door and when the wife and son of the informant came to rescue they were also assaulted. The motive of the occurrence was to restrain the informant from storing cow dung on the land which was purchased by the petitioner's side. It is submitted by learned counsel for the petitioner that for the occurrence of 30.01.2014, the complaint was filed on 10.02.2014 which came to be registered as a police case on
Patna High Court Cr.Misc. No.56962 of 2015 (2) dt.17-12-2015 2/2 01.07.2014. Actually no injury was caused to the informant's side and both sides are neighbour. Moreover, earlier 144 Cr. P.C. proceeding was initiated due to dispute between the parties. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.
Considering the delayed lodging of the case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned C.J.M., Siwan in connection with Siwan Sadar SC/ST P.S. Case No. 73 of 2014 arising out of Complaint Case No. 310 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
