JUSTICE ARUN KUMAR ORAL ORDER 23-01-2018 Heard learned Counsel for the petitioners and the State as also the learned Counsel appearing on behalf of the Informant. Petitioner, already in custody, seeks bail in Patahi PS Case No. 25 of 2017 registered under Section 379 of the IPC. Learned Counsel for the petitioner submits that except the allegation made by the co-accused in his confessional statement that the stolen tractor was sold to the petitioners there is no other material against the petitioners and even the tractor has not been recovered. The police has submitted charge-sheet.
Having considered the said facts and circumstances, the petitioners, namely, Jay Ram Singh and Sanjeev Singh are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) by both of them with two sureties of the like amount each to the satisfaction of ACJM VIII Motihari in connection with Patahi PS Case No. 25 of 2017.
