Petitioner seeks bail in a case registered for the offences punishable under Sections 354B, 364A, 353/34 of the Indian Penal Code and Section 8 of the Protection of Children from Sexual Offences Act, 2012.

Allegation against the petitioner is of commission of rape against the minor daughter of the informant. The aforesaid fact has come in the statement of the victim. The petitioner is in custody since 02.07.2017.

Learned counsel for the petitioner submits that the matter is of love affairs. Medical report does not support the prosecution allegation.

Considering the statement of the victim, I am not

Patna High Court Cr.Misc. No.54112 of 2017 (4) dt.04-01-2018 2/2 inclined to enlarge the petitioner on bail in connection with Mahila (Bihar) P.S. Case No. 130 of 2017 pending in the court of learned 1st Additional Sessions Judge-cum-Special Judge, Nalanda at Bihar Sharif. Hence, prayer is refused.

The learned trial court is directed to expedite the trial.
