JUSTICE SATYAVRAT VERMA ORAL ORDER 14-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Chakand P.S. Case No. 130 of 2020, instituted for the offences under Sections 392, 379, 411 and 34 of the Indian Penal Code. The learned counsel for the petitioner submits that the petitioner is in custody since 10.06.2021, charge-sheet has been submitted and has antecedent of one case and allegation is of looting the motorcycle, mobile and Rs. 3,000/- of the informant by three unknown criminals, the informant also in the FIR alleges that the petitioner who committed the occurrence had taken lift earlier and had disclosed his name and address. The learned counsel for the petitioner submits that petitioner has been falsely implicated as it absolutely does not

Patna High Court CR. MISC. No.53555 of 2021(2) dt.14-02-2022 2/2 stand to reason that a person who is to commit loot will disclose his identify to the victim and get implicated easily. The learned A.P.P. vehemently opposes the bail application.

Considering the fact that the petitioner is in custody since 10.06.2021, charge-sheet has been submitted and taking into consideration the submission made by the learned counsel for the petitioner, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VIII, Gaya, in connection with Chakand P.S. Case No. 130 of 2020. The application stands allowed.
