JUSTICE SHIVAJI PANDEY ORAL JUDGMENT Date: 10-01-2017 Heard learned counsel for the petitioner and counsel for the State as also counsel for the Patna University. In this case the petitioner has raised a grievance that he has acquired Ph.D. degree and hence he is entitled to two additional increments.

Before dealing with this aspect of the matter, the petitioner had earlier moved before this Court in CWJC No. 12610 of 2006 and this Court, vide order dated 16.4.2007, passed an order for filing a representation and directed the respondent concerned to dispose of the same. It was also directed that if it is found that the petitioner is entitled for payment, the University will make

Patna High Court MJC No.2259 of 2007 dt.10-01-2017 arrangement for payment of the same.

There is no plea that the representation of the petitioner has not been disposed of but that has been disposed of adverse to the interest of the petitioner. Learned counsel for the petitioner submits that the representation of the petitioner has been disposed of contrary to law.

It is only the question of forum but, the issue of entitlement cannot be gone into in the present proceeding. The petitioner, if so advised, may take appropriate action in accordance with law.

With the aforesaid observation, this application is dismissed.
