The petitioner seeks bail in a case registered under Sections 394, 411, 379 of the Indian Penal Code and Sections -25(1-b)(a), 26, 35 of the Arms Act.
The prosecution case, in short, is that while the informant along with his family members, after getting down from the bus, was going to home, the miscreants seated with him in tempo, contacted pistol to him and snatched away his belongings and of his family members.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner is in custody since 04-03-2019. Charge sheet in this case has already been submitted. The
Patna High Court CR. MISC. No.41793 of 2019(2) dt.08-07-2019 2/2 petitioner has been falsely implicated in the present case. The recovered articles were not put on TIP. The petitioner has been named in the FIR due to mistake of fact. It has further been submitted that the petitioner may be released after completion of six months in custody.
On behalf of the State, it is submitted that the petitioner is named in the F.I.R.
Considering the aforesaid facts and circumstances, it is directed that after completion of six months in custody, the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-Ist, Patna City in connection with Alamganj P.S. Case No. 164 of 2019.
