Petitioner apprehends arrest in a case registered for the offence punishable under Sections 03, 17(1), 18(2) of the IPC and P.N.D.T. Act.

As per the prosecution case, allegation against the petitioner is that he was running a medical pathological lab namely Kumar Janch Ghar at Pokhara Mohalia, Hajipur without a valid license.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The petitioner had already applied for license for pathological center and it was under process. On the alleged

Patna High Court CR. MISC. No.43833 of 2022(2) dt.05-12-2022 2/2 date the lab of the petitioner was found closed and the petitioner was not running the pathology center. Petitioner has got no criminal antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Government Official Complaint Case NO. C2-06 of 2017 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
