2. Petitioner apprehends arrest in a case registered for the offence punishable under Section 30a and other allied sections of the Bihar Prohibition and Excise Act and sections 467/468/471/120B of the IPC.

3. As per the prosecution case, 4892.400 liters foreign liquor was recovered from the DCM truck.

4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. No incriminating material has been recovered from the conscious possession of the petitioner and he is no way connected with the aforesaid recovery. Petitioner is neither owner nor driver of the vehicle in question.

5. Learned counsel appearing for the State opposes

Patna High Court CR. MISC. No.44569 of 2023(2) dt.08-08-2023 2/2 the prayer for bail and submits that petitioner has got criminal antecedent of similar nature as such he cannot be granted privilege of bail.

6. Considering the fact that the petitioner has got criminal antecedent of similar nature and the huge quantity of recovery of illicit liquor, his prayer for bail is refused. (Prabhat Kumar Singh, J) Shashi U T
