The petitioner seeks bail in Sanjhauli P. S. Case No. 80/18 instituted for the offence under Section(s) 414 of the Indian Penal Code.

It is alleged in the written report that petitioner was intercepted with a motorcycle for which he could not produce valid paper. The informant has alleged that petitioner was taking the stolen motorcycle to sale in the market. It is further alleged that at the instance of the petitioner one another motor cycle has been recovered from house of Rajnish Chaudhary for which separate case has been lodged vide case no 1049 of

Patna High Court Cr.Misc. No.58717 of 2018(3) dt.31-10-2018 2/2 2018.

Learned counsel for the petitioner has submitted that he has no concern with the aforesaid motorcycle. The seizure list bears signature of no any independent witness. There is signature of two police constables on the seizure list which is in violation of Section 100(4) of the Cr.P.C.

Considering the aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/-(Ten thousand) with two sureties of the like amount each to the satisfaction of the ACJM, Bikramganj, Rohtas at Sasaram in connection with Sanjhauli P. S. Case No. 80/18 subject to the condition that both the bailers shall be the close relative of the petitioner.
