Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302/34 of the IPC. As per the prosecution case, the informant suspects that this petitioner along with other co-accused persons, caused death of father-in-law of the informant due to land dispute. She further alleges that 5 years ago, co-accused Bhusan Singh had fired upon the deceased.
Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. She has been made accused in this case only on suspicion because of land dispute between the parties. Informant
Patna High Court CR. MISC. No.43513 of 2022(2) dt.01-12-2022 2/2 is not an eye witness of the occurrence. Petitioner is an old Pardanasin lady and there is no specific allegation of overt-act against the petitioner. Petitioner has got no criminal antecedent. Learned counsel appearing for the State opposes the prayer for bail.
Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Session Judge IX Patna in connection with Phulwarisharif P.S.
