2. This is an application for regular bail on behalf of the petitioner for the offences alleged under Section 30(a) of the Bihar Prohibition and Excise Act.

3. As per prosecution case, there has been recovery of total 40 liters of liquor from a place Birbal Diara and the petitioner was apprehended on spot.

4. The learned counsel for the petitioner has submitted that petitioner has been falsely implicated in this case and has committed no offence. Petitioner has no concern with the seized liquor. On the basis of suspicion, he has been made accused in this case. No incriminating article has been recovered from the

Patna High Court CR. MISC. No.48726 of 2024(2) dt.18-07-2024 2/2 conscious possession of the petitioner. Petitioner is a person of clean antecedent and he is in custody since 17.03.2024.

5. Learned APP for the State has opposed the prayer of bail.

6. Considering the above facts and circumstances of the case as well as petitioner has clean antecedent, let the petitioner, above-named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Special Excise Judge 2nd , Khagaria in connection with Pasraha P.S. Case No. 56 of 2024, subject to the condition that the petitioner shall co-operate in the disposal of trial and make himself available as and when required by the Court.
