The petitioner seeks regular bail in connection with Sessions Trial No. 330 of 2017 arising out of K. Hat (Sahayak) P.S.Case No. 553 of 2017/ G.R. No. 3055 of 2017 registered for offences punishable under Section 379, 411 and 413/34 of the Indian Penal Code.
The informant as alleged in the F.I.R. is that he is an employee in Magma Finance Company and parked his motorcycle out side the office. When he returned after finishing his duty he found that his motorcycle to be missing and on such allegation, F.I.R. was registered against unknown person. The name of the petitioner has surfaced in this case on the basis of
Patna High Court Cr.Misc. No.59295 of 2017 (3) dt.15-01-2018 2/2 confessional statement made by one co-accused, Md. Chand Alam in which it has been stated that he used to steal motorcycle and sell to other co-accused. It has been contended on behalf of the petitioner that similarly situated co-accused, Md. Md. Shamim @ Shamim Akhtar has been granted bail vide order dated 20.11.2017 passed in Cr. Misc. No. 55872 of 2017. It is also submitted that the petitioner is in custody since 10.08.2017. Considering the facts and circumstances and the materials on record, let the petitioner, above named be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned 3rd Additional Sessions Judge, Purnia in connection with Sessions Trial No. 330 of 2017 arising out of K.Hat (Sahayak) P.S. Case No. 553 of 2017/ G.R. No. 3055/2017.
