Petitioner seeks bail in Noorsarai P.S. Case No.329 of 2018 instituted for the offence under Section(s) 302, 120B/34 Indian Penal Code. It is alleged that daughter of the informant had gone to attend marriage ceremony in village, but she did not return. The informant learnt in the village on the next day that dead body of a girl is lying in ditch of the village. The informant went there and identified dead body of his daughter. The informant has raised suspicion against the accused persons as named in the written report for committing murder of his daughter. During investigation, it has come that one Sonu was having love affair with the deceased. Brother-in-law of the
Patna High Court CR. MISC. No.41529 of 2019(2) dt.10-07-2019 2/2 deceased, Amar Nath Paswan, had also love affair with the deceased. Sonu has told before the police that he learnt that brother-in-law of the deceased along with her father has committed murder of the deceased.
In this manner, name of the petitioner has come in the confessional statement of co-accused. Petitioner is father of the deceased.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Nalanda at Biharsharif, in connection with Noorsarai P.S. Case No.329 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner. (Sanjay Priya, J) J. Alam/- U T
