JUSTICE DINESH KUMAR SINGH ORAL ORDER 12-01-2016 Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 341, 504, 506 of the Indian Penal Code and Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act.

The prosecution case is that the informant being employee of the Forest Department was threatened by the petitioner for non-payment of arrears of wages. It is submitted by learned counsel for the petitioner that even assuming the accusation, no offence under Section 3(1)(x) of the SC & ST (Prevention of Atrocities) Act is made out. Moreover, for the occurrence of 19.08.2015 the F.I.R has been registered after two months of the occurrence on 19.10.2015.

Considering the delayed lodging of the case and the nature of accusation, let the petitioner, above named,

Patna High Court Cr.Misc. No.1530 of 2016 (2) dt.12-01-2016 2/2 in the event of his arrest or surrender before the Court below within a period of 12 weeks from today, be released on anticipatory bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Bhojpur at Ara in connection with SC/ST P.S.
