JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-02-2016 The present application has been filed for modification of the order dated 9.10.2015 passed in Criminal Miscellaneous No.24552/2015 for extending the period of surrender.

Though, the order dated 9.10.2015 has been passed by a co-ordinate Bench of this Court but the matter has been placed before this Court in view of the administrative order of Hon'ble the Acting Chief Justice dated 9.2.2016 in view of the fact that the co-ordinate Bench is not available due to medical exigency.

Counsel for the petitioner confines the prayer to the extent of extending the period of surrender only. On the grounds mentioned in the modification application, let the date of surrender be extended by three weeks calculated from the date of receipt or production of copy of the

Patna High Court Cr.Misc. No.55964 of 2015 (2) dt.11-02-2016 2/2 order.

The order dated 9.10.2015 stands modified to the extent indicated above.

Rest of the conditions as stipulated in the above order will remain the same.

Accordingly, the modification application is disposed of in connection with Sonepur P.S. Case No.498/2014, pending before learned CJM, Saran at Chapra.
