The petitioner seeks bail in Katra P.S. Case No. 158/2018, instituted for offence under Section(s) 498A of the Indian Penal Code read with Sections 3 and 4 of D.P. Act. It is alleged in the written report that informant was married with this petitioner in the year 2015. One child was born from the wedlock. After marriage informant was tortured in her Sasural by this petitioner and other family members for non-fulfillment of demand of car. It is alleged that on 04.07.2018, informant was ousted from her matrimonial house after snatching her belongings.

The informant along with her lawyer are present in Court. She is ready to live with her husband (petitioner).

Patna High Court CR. MISC. No.41956 of 2019(2) dt.12-07-2019 2/2 Learned counsel for the petitioner has submitted that he is not ready to keep his wife (informant). In view of such, this Court is not inclined to grant bail to petitioner. Accordingly, prayer for bail of petitioner is rejected.

The trial court is directed to expedite the trial. Petitioner will be at liberty to renew prayer for bail after six months in the event no substantive progress is made in trial.

In the event petitioner files necessary petition before the court below stating therein that he is ready to keep his wife, the court below shall pass appropriate order on such petition in accordance with law without being prejudiced by this order. (Sanjay Priya, J) rakhi/- U T
