Patna High Court Cr.Misc. No.58619 of 2015 (2) dt.01-02-2016 2/3 learned Assistant Public Prosecutor for the State. This application for grant of anticipatory bail arises out of Sandesh PS Case No. 150 of 2015 disclosing offences under Sections 147, 149, 341, 323, 285, 353, 332 and 504 of the Indian Penal Code.
Learned counsel for the petitioners submits that similarly circumstanced co-accused Nand Gopal Singh has been granted anticipatory bail by this Court by order dated 26.11.2015 passed in Cr. Misc. No. 53607 of 2015. He submits that accusation against all the main accused persons is general and omnibus. He further submits that it is not known how the Officer-in-charge could identify all the accused persons who were allegedly involved in blocking the road and manhandling the police personnel.
Considering the above submission, this application is allowed. It is directed that in the event of their arrest, the petitioners above-named, shall be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Ara, in connection with Sandesh PS Case No. 150 of 2015, subject to the conditions as laid down under Section 438(2) CrPC. This is subject to the further condition that the petitioners shall present themselves before the police/Court below, as the case may be, as and when required and in the event of failure on their part to appear before the Court on
Patna High Court Cr.Misc. No.58619 of 2015 (2) dt.01-02-2016 3/3 two consecutive occasions, their bail bonds shall be liable to be cancelled.
