The petitioner seeks regular bail in connection with G.O. 170/2017/828/17 instituted for the offences under Sections 272, 273 and 34 of the Indian Penal Code and Section 30(A) of the Bihar Prohibition and Excise Act, 2016.

The allegation is regarding recovery of 54 litres of illicit Nepali Saufi liquor from a place situated at the border. The learned counsel for the petitioner submits that the fact is that no recovery has been effected from the conscious possession of the petitioner and he has a clean antecedent and is in custody since 28.09.2017.

Considering the nature of accusation, the period of

No.58877 of 2017 (2) dt.22-12-2017 2/2 custody already undergone and the fact that the petitioner has got a clean antecedent, I direct the petitioner named above to be released on regular bail on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-II cum Special Judge, (Excise Act), Sitamarhi in connection with G.O. 170/2017/828/17.
