The petitioner is languishing in custody for the offence punishable under Sections 302 and 120(B) of the Indian Penal Code and Section 27 of the Arms Act.

According to F.I.R., the petitioner and two others fired at the husband of the informant indiscriminately. The doctor has found three fire arm wounds on the person of the deceased.

Learned counsel for the petitioner has drawn attention of the Court towards progress of the investigation and different infirmities to submit that that the informant does not appear to be an eye witness of the occurrence. He further submits that petitioner has got no criminal antecedent. Petitioner is in

Patna High Court CR. MISC. No.756 of 2021(4) dt.26-04-2021 2/2 custody since 28.07.2020. Investigation of the case is already complete.

Considering the facts of this case aforesaid, especially the nature of injuries found on the person of the deceased which is consistent with the prosecution allegation, I am not inclined to enlarge the petitioner on bail for the present in connection with Kalyanpur P.S. Case No. 18 of 2019.

Hence, prayer is refused.
