The petitioners seek bail in a case registered for offences punishable under Sections 272 and 273 of the I.P.C. and Sections 30 (a) and 38(b) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 15.750 litres foreign liquor was recovered from the hut allegedly belonging to the petitioner no.1. Petitioners claim that they are having clean antecedent and they surrendered on 08.09.2017 and since then they are in custody.

No.53096 of 2017(2) dt.09-11-2017 2/2 Having regard to the facts and the circumstances of the case, the abovenamed petitioners are directed to be released on bail on their furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Special Judge, Excise Act, Muzaffarpur in connection with Town P.S. Case No. 545/2017. Further, if the petitioners, after their release in this case, are again found to be involved in similar nature of case then the court concerned would be at liberty to take steps for cancellation of their bail bonds.
