The petitioner apprehends his arrest in Jamo Bazar P.S. Case No. 24/2015, registered for the offences punishable under Section 304B and 201 of the Indian Penal Code. The petitioner is the husband of the deceased. The informant alleged that the petitioner and his father were torturing his daughter and he got information that his daughter was killed and her dead-body was cremated.

It is submitted that the marriage of the petitioner was solemnized with the deceased in the year 2000. No dowry was ever demanded. The son of the deceased in para 8 of the case diary disclosed that his mother was ill, but it appears that the wife of the petitioner was killed and petitioner did not inform the father and

Patna High Court Cr.Misc. No.42784 of 2015 (3) dt.09-12-2015 2/2 other relatives of the deceased. The Supervising Authority also found the case true under Section 302 of the I.P.C. Considering the facts aforesaid, I am not inclined to enlarge the petitioner, husband of the deceased on anticipatory bail. Accordingly, the same is rejected.

The petitioner however, if so advised, may surrender before the court below within four weeks from the date of receipt/production of a copy of this order and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
