The petitioner seeks regular bail in connection with Vaishali (Belsar O.P.) P.S.Case No. 167/2020, registered for the offence punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2018.

The allegation is regarding recovery of huge quantity of illicit liquor from a truck, which is stated to be standing in an open field belonging to one Ranjit Rai, son of Kapal Rai.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he has

The learned counsel for the petitioner has further submitted that the name of the petitioner, who is son of one Gani Nath Rai @ Ganinath Ray, has transpired in the present case upon the police having received secret information to the effect that the petitioner was also dealing in illicit liquor.

Per contra, the learned APP for the State has vehemently opposed the prayer for bail.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner and taking into account the materials available on record as also considering the fact that the petitioner has neither been arrested from the spot nor the place from where the alleged truck, containing the illicit liquor, was seized, belongs to the petitioner herein, I deem it fit and proper to direct for release of the petitioner on regular

Patna High Court CR. MISC. No.53229 of 2021(2) dt.16-12-2021 3/3 bail.

Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-II-cum-Special Judge, Excise Act, Vaishali at Hajipur in connection with Vaishali (Belsar O.P.) P.S.Case No. 167/2020.
