This is a petition for grant of anticipatory bail for offence under Sections 415, 467, 468, 471, 420, 406 and 34 of the Indian Penal Code.

Petitioner no. 1, Vinay Singh @ Vinay Krishna Singh, has already been arrested, as submitted by the learned counsel for the petitioners.

Hence, his prayer for anticipatory bail is dismissed as infructuous.

According to the complaint petition co-accused, Vivek Kumar, who is relation of the complainant, was partner of the husband of the complainant in the business of plying of truck. After death of the husband, Vivek Kumar was allowed to ply the truck. Later on Vivek Kumar took papers of the truck from the complainant on the pretext of showing the same at the time of checking of the truck. However, he created a forged transfer documents said to be executed by the complainant in favour of Vivek Kumar and this petitioner.

Patna High Court Cr.Misc. No.52686 of 2016 (2) dt.21-12-2016 Submission of the petitioner is that the complainant has sold the truck to the petitioner, Krishna Singh @ Jay Krishna, and false allegation is there as some other person allured to give better price of the truck.

Considering the aforesaid fact, petitioner no. 2, Krishna Singh @ Jay Krishna, in the event of his arrest or surrender, within four weeks from the date of receipt of this order, be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Townpsc 317 of 2016 to the satisfaction of the Chief Judicial Magistrate, Begusarai, or successor Court, subject to the condition laid down under Section 438(2) of the Criminal Procedure Code.
