This is an application for bail in connection with Asarganj P.S. Case No. 68 of 2017 registered for the offences punishable under Section 392 of the Indian Penal Code. Petitioner is not named in the FIR. However, it appears that on the basis of confessional statement looted motorcycle was recovered from the house of the petitioner and he has criminal antecedents also.

Submission of learned counsel for the petitioner is that no recovery has been made from his conscious possession, rather recovery has been made from a joint house and even TIP has not been held till date. Further submission is that petitioner is in custody for more than five months.

Having heard both sides and in the facts and circumstances of the case, I am not inclined to grant bail to the petitioner. Hence, prayer for bail is rejected. (Vinod Kumar Sinha, J) spal/- U
