Petitioner is apprehending his arrest in a case registered for the offences punishable under Sections 448, 376, 511, 323, 324, 506 of the Indian Penal Code. The prosecution case is that the petitioner entered into the house of the informant and tried to commit rape upon her. The petitioner inflicted injury with knife on the informant and her son.

It is submitted by the learned counsel for the petitioner that earlier the sons of the informant demanded extortion from the petitioner and on non-payment, they assaulted the petitioner, for which Paroo P.S. Case No. 30 of 2012 was registered. The injury of the son of the informant has been found to be simple in nature. Statement has been made in

Patna High Court Cr.Misc. No.55802 of 2015 (2) dt.09-12-2015 para-3 of the petition that petitioner has no criminal antecedent.

Let the learned court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders before the learned court below within a period of six weeks from today in connection with Paroo P.S. Case No. 29 of 2012, pending in the court of learned Sub-Divisional Judicial Magistrate, Muzaffarpur.

With the above observation this application is disposed of.
