Earlier the prayer for bail of the petitioner was disposed of with direction to the learned trial court to verify the fact that after submission of the charge-sheet, if there is nothing against him except suspicion, he may release the bail on bail, however, his prayer for bail was again rejected. Submission of the learned counsel for the petitioner is that except last seen there is nothing incriminating against him and another co-accused having similar allegation has already been granted bail, vide order dated 10.1.2018 passed in Cr. Misc. No.59279 of 2017.
Heard learned A.P.P. also.
Having heard both sides and in view of the facts and
Patna High Court Cr.Misc. No.60826 of 2017 (3) dt.17-01-2018 2/2 circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of Sri Shiv Kumar, J.M. 1st Class, Uda Kishunganj, Madhepura in connection with Gwalpara (Arar O.P.) P.S.Case No.87 of 2016 with condition that he will co-operate in disposal of the trial and will also appear as and when required by the learned court below; otherwise his bail bond shall be cancelled. With the aforesaid observation, this application is allowed.
