The petitioner has preferred this application for grant of regular bail in a case registered under section 307 and other sections of the Indian Penal Code.

As per the prosecution case, the informant states that on receiving information about the petitioner having assaulted Harendra Kumar with a dabi it is stated that he was making an attempt to escape on his motorcycle. Orders were given to the informant to catch hold of him. On reaching the place of occurrence it is stated that the petitioner who was on a motorcycle dashed his motorcycle on the informant with the intention to kill him.

It is submitted by learned counsel for the petitioner

Patna High Court CR. MISC. No.55607 of 2021(2) dt.05-04-2022 2/2 that the petitioner has been falsely implicated in the case. Even from bare perusal of the FIR, the allegations as leveled by the informant against the petitioner is not made out. The petitioner is in custody since 21.10.2020 and investigation in the case has concluded.

Heard learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts of the case together with the petitioner having remained in custody for 1 year 5 months and charge sheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Bihta P.S. Case no. 692 of 2020 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, Danapur, District Patna.
