Petitioners are apprehending their arrest in a case registered for offences punishable under Sections 341, 420, 467, 468, 471, 387 and 120(B) of the Indian Penal Code. It has been submitted on behalf of the petitioner that out and out false and baseless allegations have been levelled against the petitioners as the petitioners are only deed writer and identifier of the sale deed and has no concern with alleged execution of the land.

Considering the submission, as above, and the fact that the petitioners have no specific role to play in the offence, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within a period six weeks, be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Sikranha at Dhaka, East Champaran, in connection with Dhaka P.S. Case No. 98 of 2016, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure. This is subject to the condition that the petitioner shall present themselves before the police/Court, as the case may be, as and when required and in the event of failure on their part to appear before the Court on two consecutive occasions, their bail bond shall be liable to be cancelled.
