The petitioner seeks bail in a case registered for offences under Sections 30 (a) of the Bihar Prohibition and Excise Act, 2016.

It is contended that, as per allegation, 24 litres of country made liquor was recovered from the vehicle which was being driven by the petitioner. Petitioner claims that he is having clean antecedent and is in custody since 13.09.2017.

Considering the facts and the circumstances of the

No.53540 of 2017(2) dt.09-11-2017 2/2 case, the petitioner, above named, is directed to be released on bail on his furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional District and Sessions Judge-II-cum-Special Judge, Excise, Nawada in connection with Akbarpur P.S. Case No. 203 of 2017 with a condition that one of the bailors of the petitioner must be the close relative or his family member, who will file affidavit before the court below giving full genealogy showing his or her relationship with the petitioner and other bailor of the petitioner will be the resident of Bihar since the petitioner belongs to Jharkhand.

Further, if the petitioner, after his release in this case, is again found to be involved in criminal case of similar nature, the court concerned would be at liberty to take steps for cancellation of his bail bonds. (Dr. Ravi Ranjan, J) Vikash/- U T
