Petitioner seeks regular bail in connection with Muffasil PS Case No. 443 of 2020 registered under Sections 399 / 402 of the I.P.C. and Section 25 (1-B) (a) / 26 / 35 of the Arms Act.
Police on the basis of secret information that some miscreants have assembled in the house of one Surendra Singh and were doing preparation for committing offence raided the said house and arrested the petitioner along with one country made pistol and two live cartridges.
Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case and at the time of search and seizure the procedures prescribed in the Cr.P.C.
Patna High Court CR. MISC. No.53394 of 2021(2) dt.12-05-2022 2/2 have not been followed. He next submits that petitioner is in custody since 3/9/2020 i.e. for about more than 11⁄2 years. Regard being had to the submissions made by the parties, taking into consideration the materials available on record, the period of custody i.e. for about 11⁄2 years and charge sheet has already been submitted , as such, I am inclined to grant regular bail to the petitioner.
Let the petitioner, above named, be released on regular bail on furnishing bail bond of Rs. 20000/- (twenty thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Muffasil PS Case No. 443 of 2020.
