JUSTICE DINESH KUMAR SINGH ORAL ORDER 04-01-2016 Heard learned counsel for the petitioners and learned APP for the State.

Petitioners being the owner and driver of the vehicle are apprehending their arrest in a case registered for the offences punishable under Section 414 of the Indian Penal Code and 11 (d) (e) (f) of the Prevention of Cruelty to Animal Act.

The prosecution case is that six cattles were recovered from the pickup van of the petitioners. It is submitted by the learned counsel for the petitioners that the animals were being transported on the basis of bona fide purchase and maliciously petitioners have been roped in the present case. Statement has been made in

Patna High Court Cr.Misc. No.57918 of 2015 (2) dt.04-01-2016 para-3 of the petition that petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on bail in the event of their arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of learned Sri Arun Tiwari, Judicial Magistrate, Ist Class, Gopalganj, in connection with Baikunthpur P.S. Case No. 169 of 2015, subject to conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
