Petitioner's counsel submits that the petitioner has been implicated in this case merely on the allegation that his profile tallies in the footage of the CCTV. In spite of opportunity having been granted by earlier orders, the petitioner's profile has not been compared with the CCTV footage as is evident from the report dated 09.01.2018 submitted by the Court below. The petitioner is in custody since 16.02.2016 in this case. Though he is accused in many other cases, details of which he has disclosed in paragraph 3 of the bail application, but in some of the cases, he is on bail and in others, he is in custody.

Be that as it may, considering the aforesaid

Patna High Court Cr.Misc. No.56603 of 2017 (5) dt.31-01-2018 2/2 submissions, prayer for bail, in the instant case, is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate XI, Vaishali at Hajipur in Jandaha Police Station Case No 227 of 2015 subject to the following conditions:

(1) That one of the bailors will be a close relative of the petitioner who will give an affidavit giving genealogy as to how he is related with the petitioner. The bailor will also undertake to inform the Court if there is any change in the address of the petitioner.

(2) That the petitioner will be well represented on each date and if he fails to do so on two consecutive dates, his bail will be liable to be cancelled.
