The petitioner seeks bail in connection with Muffasil P.S. Case No. 465 of 2018 registered under Sections 25(1-b)a, 26/35 of the Arms Act.

Petitioner is said to have been apprehended along with country made pistol and a live cartridge. It is submitted by learned counsel for the petitioner that no incriminating article has been recovered from conscious physical possession of the petitioner. He has been falsely implicated in this case at the instance of his enemy by planting the aforesaid recovery from his possession. He has been languishing in custody since 01.08.2018.

No.68121 of 2018(3) dt.13-02-2019 2/2 On the other hand, learned APP opposing the bail prayer of the petitioner submitted that the petitioner is having criminal antecedent, hence, he does not deserve bail. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Motihari, District-East Champaran in connection with Muffasil P.S. Case No. 465 of 2018. However, learned lower court is directed to accept the bail bond of the petitioner after two months from the date of this order. (Prakash Chandra Jaiswal, J) rohit/- U T
