The petitioner seeks bail in Morkahi P.S. Case No. 60 of 2016 registered under Section 302/34 of the Indian Penal Code and Section 27 of the Arms Act.

11 motorcycle and Bolero borne unknown criminals are said to have committed murder of brother-in-law of the informant and also injured the informant and one another. It is submitted by learned counsel for the petitioner that the petitioner is not named in the F.I.R. The allegation levelled against the petitioner is not specific rather omnibus. The petitioner has been falsely implicated in the case due to dirty village politics. The deceased was a notorious criminal and he might have been killed by some unsocial elements. Though the

Patna High Court Cr.Misc. No.53727 of 2017 (2) dt.09-11-2017 2/2 name of the petitioner has surfaced in Para-27, 28 and 29 of the case diary, but the witnesses of the said paras do not happen to be eye witnesses of the occurrence. The petitioner has been languishing in custody since 10.08.2017.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Khagaria in connection with Morkahi P.S. Case No. 60 of 2016 (Prakash Chandra Jaiswal, J) Mishra/- U T
