The petitioner seeks bail in Akhorigola P.S. Case No. 77 of 2017 registered under Section 302/34 of the Indian Penal Code.
As per the prosecution case, the husband of the informant is said to have been gunned down by the petitioner and three other named accused persons by way laying him. It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence and has been falsely implicated at the instance of his enemies due to dirty village politics. Neither the informant nor any of the person is the eye witness of the occurrence. The postmortem report of the deceased also indicates that he has sustained only one
Patna High Court Cr.Misc. No.54435 of 2017 (03) dt.13-12-2017 - 2 - firearm injury on his chest. Hence, the assailant of the said injury is not ascertained. The allegation levelled against the petitioner is not specific rather general and omnibus in nature. The petitioner has been languishing in custody since 09.08.2017. In the facts and circumstances of the case, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Dehri, District Rohtas in connection with Akhorigola P.S. Case No.77 of 2017.
